TRIPTAP TERMS OF SERVICE AND END-USER LICENSE AGREEMENT

These Terms of Service and End-User License Agreement (the “Terms”) are a legally binding agreement between you and TripTap (“TripTap,” “we,” “us,” or “our”). TripTap operates from the Republic of Moldova and may be contacted at support@triptap.app.

These Terms govern your access to and use of the TripTap mobile application, its associated websites, software, content, artificial-intelligence features, subscription services, and related functionality (collectively, the “Service”).

By downloading, installing, accessing, creating an account, purchasing a subscription, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

1. Eligibility and authority

You must be at least 16 years old to create an account or use the Service. If the law applicable to you requires a higher minimum age, parental authorization, or another form of valid consent, you may use the Service only after those requirements have been satisfied.

If you are under the age of legal majority where you live, you represent that your parent or legal guardian has reviewed and accepted these Terms on your behalf and is responsible for your use of the Service.

If you use the Service for or on behalf of a company or other organization, you represent that you have authority to bind that organization. In that case, “you” includes both you and that organization.

You may not use the Service if you are legally prohibited from receiving or using it, are subject to applicable trade sanctions that prohibit such use, or have previously been suspended or removed from the Service unless we have expressly authorized your return.

2. The Service

TripTap is a travel-planning and discovery tool that may allow users to:

  • create and manage an account and travel profile;
  • save travel spots, notes, ratings, source links, addresses, coordinates, categories, and related information;
  • organize spots by city or country;
  • create trips, destinations, dates, itineraries, routes, and day-by-day plans;
  • import, analyze, or extract travel-related information from supported links or media;
  • receive AI-assisted travel suggestions, summaries, extracted information, and recommendations;
  • upload avatars, chat images, and other permitted content;
  • use maps, places, geocoding, directions, device-location, and route-related functionality; and
  • access paid features through subscriptions or other in-app purchases.

The Service is a planning and informational tool only. TripTap is not a travel agency, tour operator, carrier, accommodation provider, booking agent, insurance provider, immigration adviser, emergency service, navigation authority, or professional adviser. Unless expressly stated otherwise, we do not sell, operate, control, verify, endorse, or guarantee any destination, attraction, route, business, transportation service, accommodation, event, product, or third-party service displayed or mentioned through the Service.

Features may vary by device, operating system, country, language, subscription plan, account status, and Service version. Certain features may be experimental, unavailable, restricted, changed, or discontinued at any time.

3. Privacy and data processing

Our collection, use, storage, disclosure, and retention of personal data are described in our Privacy Policy, which is made available through the App. The Privacy Policy forms part of these Terms.

Depending on the features you use, the Service may process information such as account details, profile information, age range, travel interests and preferences, saved spots, trips, dates, itineraries, notes, ratings, source links, addresses, coordinates, device location, chat history, uploaded images, subscription status, transaction identifiers, technical information, IP address, request logs, and security information.

To operate the Service, information may be processed by third-party providers, including authentication providers, AI providers, mapping and directions providers, cloud-storage and infrastructure providers, and Apple’s billing services. When you use AI features, relevant chat messages, prompts, preferences, spot information, extracted text, video frames, and images may be sent to an AI service provider to generate the requested output. Further details are provided in the Privacy Policy.

You must not submit highly sensitive, secret, regulated, or confidential information through the Service unless the Service expressly requests it and you are legally entitled to provide it. This includes passwords, authentication credentials, financial account information, government-identification documents, private medical records, confidential business information, or intimate content.

Some uploaded media may be delivered through link-addressable cloud storage. Anyone who obtains the exact media URL may be able to access the media. Do not upload chat images, avatars, or other content that you require to remain strictly confidential. The Privacy Policy must be reviewed for the most current description of media access and storage.

4. Account registration and security

You may need an account to use some or all of the Service. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for:

  • maintaining the confidentiality and security of your account, device, login method, and credentials;
  • all activity occurring through your account, except to the extent caused solely by our breach of a legal duty;
  • promptly notifying us at support@triptap.app if you suspect unauthorized access, account compromise, or misuse; and
  • signing out from devices you do not control.

You may sign in using Apple, Google, or another supported authentication provider. Your use of that sign-in method is also subject to the provider’s terms and privacy practices. We are not responsible for the availability, security, or operation of third-party authentication services.

You may not sell, rent, transfer, share, or commercially exploit your account. We may require identity or ownership verification before restoring access, changing account information, or processing a deletion request.

5. License to use the App

Subject to your continuing compliance with these Terms, TripTap grants you a limited, personal, revocable, non-exclusive, non-sublicensable, and non-transferable license to install and use the App for lawful, personal, non-commercial purposes on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and applicable Usage Rules. The App may also be accessed by accounts associated with the purchaser through Family Sharing, volume purchasing, or eligible Legacy Contacts where permitted by Apple.

The Service is licensed, not sold. No ownership right in the App, Service, software, databases, models, interfaces, trademarks, or other TripTap materials is transferred to you.

Except where applicable law expressly permits it, you may not:

  • copy, reproduce, distribute, publicly display, sell, lease, sublicense, or commercially exploit the Service;
  • reverse engineer, decompile, disassemble, decode, discover source code, bypass protections, or create derivative works from the Service;
  • modify, remove, obscure, or circumvent copyright, trademark, access-control, paywall, security, usage-limit, or attribution mechanisms;
  • use automated scripts, bots, scrapers, crawlers, data-mining systems, or similar tools to access or extract information from the Service without our prior written permission;
  • use the Service or its outputs to train, fine-tune, benchmark, or develop a competing model, product, database, or service without our prior written permission; or
  • use the Service in a manner inconsistent with Apple’s applicable Usage Rules or other binding third-party terms.

6. User content

“User Content” means information or material you submit, save, upload, transmit, create, or make available through the Service, including profile information, biographies, avatars, spots, notes, ratings, URLs, destinations, trip plans, itineraries, chat messages, prompts, uploaded images, and feedback.

6.1 Ownership

As between you and TripTap, you retain any ownership rights you lawfully hold in your User Content. These Terms do not transfer ownership of your original User Content to us.

6.2 License to TripTap

You grant TripTap and its service providers a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, format, adapt, transmit, display, process, analyze, and otherwise use your User Content only as reasonably necessary to:

  • provide, maintain, secure, troubleshoot, personalize, and improve the Service;
  • generate AI-assisted responses and recommendations you request;
  • process links, images, routes, places, and travel information;
  • prevent fraud, abuse, security incidents, and violations of these Terms;
  • comply with law, valid legal process, and enforceable governmental requests; and
  • exercise and defend legal rights.

This license continues for as long as your User Content is stored by or for the Service. It ends when the relevant User Content is deleted from active systems, except that copies may remain temporarily in backups, logs, security records, legal records, or systems where retention is required by law or reasonably necessary to establish, exercise, or defend legal claims.

We do not obtain a general right to sell your User Content as standalone content or use private User Content in advertising merely because you submitted it, unless you separately consent.

6.3 Your responsibilities

You represent and warrant that:

  • you own your User Content or have all rights, permissions, and lawful bases needed to submit and authorize its processing;
  • your User Content and our permitted use of it do not violate any law, contractual obligation, privacy right, publicity right, confidentiality duty, intellectual-property right, platform rule, or other third-party right;
  • information you submit about other people is provided lawfully and with any required notice or consent; and
  • you will not submit content that is unlawful, fraudulent, deceptive, threatening, abusive, hateful, sexually exploitative, invasive of privacy, malicious, defamatory, or otherwise prohibited by these Terms.

You are solely responsible for retaining independent copies of User Content you do not want to lose. The Service is not a permanent archive or backup service.

6.4 Moderation and removal

We may, but are not required to, review, restrict, refuse, remove, disable, preserve, or disclose User Content when we reasonably believe it violates these Terms, creates risk or liability, infringes rights, threatens safety or security, is technically harmful, or must be addressed to comply with law or a valid request. Our decision not to take action in one instance does not waive our right to act later.

7. Third-party links, social platforms, and imported content

The Service may let you submit or process links from third-party platforms, websites, or services, including social-media and video platforms. You may use this functionality only for lawful travel planning and only where you are permitted to access and process the relevant material.

You must not use TripTap to bypass access controls, paywalls, geographic restrictions, technical restrictions, copyright protections, or platform rules. You must not submit private, restricted, unlawfully obtained, or infringing material.

Third-party content remains the responsibility of its owner or provider. TripTap does not claim ownership of third-party content merely because a link or excerpt is processed by the Service. Availability, accuracy, legality, and continued access to imported content may depend on third-party platforms, which may change, block, remove, or restrict content without notice.

TripTap is not sponsored by, endorsed by, or affiliated with Apple, Google, OpenAI, TikTok, Instagram, YouTube, Amazon Web Services, Cloudflare, or any other third-party provider merely because its technology, content, or service is referenced or used.

8. Artificial-intelligence features

Some features use automated systems or third-party artificial-intelligence models to extract information, analyze links or images, generate chat responses, recommend places, organize travel data, or help create itineraries.

AI output is generated probabilistically and may be incomplete, inaccurate, outdated, misleading, offensive, unsuitable, duplicated, or fabricated. AI output may incorrectly identify a place, address, business, route, restriction, schedule, price, safety condition, travel requirement, or other fact. It may also resemble content created by others.

You must independently verify important information with authoritative and current sources before acting on it, including:

  • visa, immigration, customs, border, health, vaccination, and entry requirements;
  • laws, local rules, permits, closures, warnings, and travel advisories;
  • addresses, business hours, availability, prices, reservations, and accessibility;
  • routes, transport schedules, traffic, road conditions, weather, terrain, and safety risks; and
  • medical, legal, financial, insurance, or emergency information.

AI output is not professional advice and must not be used as the sole basis for decisions that could affect health, safety, legal rights, immigration status, finances, or significant travel expenditure. In an emergency, contact the appropriate local emergency service or qualified authority rather than relying on TripTap.

You are responsible for your prompts, use of AI output, and any decision, publication, or action based on that output. We do not guarantee that AI output is unique, protectable by intellectual-property law, non-infringing, or suitable for a particular purpose.

You may not use AI features to facilitate crime, fraud, harassment, exploitation, discrimination, dangerous activity, infringement, malware, evasion of law enforcement, or any other unlawful or harmful purpose.

9. Location, maps, routes, and travel safety

The Service may use device location, user-provided coordinates, mapping information, geocoding, places data, and directions to group spots, display places, suggest routes, or optimize itineraries.

Location, map, place, and route information may be approximate, incomplete, unavailable, delayed, or incorrect. Routes may not account for current closures, construction, weather, accessibility, private property, restricted areas, terrain, local rules, vehicle limits, transport disruptions, personal fitness, or other hazards.

The Service is not a certified navigation system and must not be used for emergency dispatch, aviation, maritime navigation, wilderness survival, or any activity where inaccurate location or route information could cause death, injury, detention, property damage, or serious loss.

You are solely responsible for:

  • checking official maps, signs, instructions, transport information, and local conditions;
  • complying with traffic laws, access restrictions, property rights, permits, and local regulations;
  • not handling or viewing the App while driving or operating machinery;
  • deciding whether a destination, route, activity, or business is safe and appropriate for you;
  • obtaining passports, visas, permits, insurance, vaccinations, bookings, and other required documentation; and
  • all travel costs, cancellations, delays, losses, injuries, disputes, and consequences arising from your travel decisions.

Do not enter private property, unsafe areas, closed sites, restricted zones, or unlawful locations based on information shown in the Service.

10. Subscriptions, in-app purchases, and billing

Some or all features may require a paid auto-renewable subscription or other in-app purchase. The available plan, subscription duration, included features, introductory offer, trial period, renewal price, currency, and billing period will be displayed in the App Store purchase interface before you confirm payment.

For purchases made through Apple:

  1. Payment is charged to the Apple Account associated with your App Store purchase when you confirm the transaction.
  2. An auto-renewable subscription renews automatically for the applicable billing period unless it is cancelled before renewal in accordance with Apple’s rules.
  3. Apple may begin attempting to renew the subscription during the period before its expiration.
  4. You may view, manage, change, or cancel your subscription through your Apple Account subscription settings.
  5. Where offered, a free or discounted trial converts to a paid subscription unless cancelled before the trial ends. Apple recommends cancelling at least 24 hours before the end of a free or discounted trial if you do not want it to renew.
  6. Purchases may be eligible for Family Sharing only where the relevant product and Apple rules permit it.
  7. You may use the App’s “Restore Purchases” function, where available, to restore eligible purchases associated with the same Apple Account.

Deleting the App or deleting your TripTap account does not automatically cancel an Apple subscription. You must separately cancel the subscription through Apple’s subscription-management settings.

Apple processes payments, refunds, billing disputes, taxes collected through the App Store, and payment-method issues under Apple’s applicable terms and policies. We do not receive or control your complete payment-card information. Except where applicable law requires otherwise, fees are non-refundable and we do not provide refunds, credits, or prorated refunds for unused time. You may request an App Store refund directly from Apple.

We may change subscription features or prices prospectively. Any price change for an existing Apple subscription will be handled through Apple’s notice and consent processes where required. If you do not agree to a future price, you may cancel before it takes effect.

Failure to pay, expiration, cancellation, refund, chargeback, billing error, or revocation of a transaction may result in loss of paid access. We may correct subscription-entitlement errors and prevent duplicate, fraudulent, or unauthorized use.

11. Acceptable use

You agree not to use the Service to:

  • violate any law, regulation, sanction, court order, or third-party right;
  • impersonate another person or misrepresent identity, affiliation, ownership, or authority;
  • stalk, threaten, harass, exploit, abuse, discriminate against, or endanger another person;
  • collect, publish, or misuse another person’s private or personal information;
  • upload malware, malicious code, corrupted files, or content intended to compromise systems or accounts;
  • interfere with, overload, probe, scan, test, disrupt, or gain unauthorized access to the Service or related systems;
  • evade rate limits, subscription controls, access restrictions, safety systems, or enforcement actions;
  • create multiple accounts to abuse trials, promotions, limits, or paid functionality;
  • submit false reviews, deceptive ratings, fabricated reports, or misleading travel information;
  • use the Service for spam, unsolicited promotion, unauthorized advertising, or unlawful commercial solicitation;
  • infringe copyright, trademark, database, privacy, publicity, contractual, or other rights;
  • scrape or systematically extract spots, routes, recommendations, user data, or other content;
  • resell, white-label, mirror, frame, or commercially provide access to the Service without written authorization;
  • use the Service to plan or facilitate dangerous, unlawful, restricted, or exploitative activity; or
  • encourage, assist, or enable anyone else to do any of the foregoing.

We may apply technical limits, rate limits, security checks, content restrictions, or account controls to protect the Service and its users.

12. Intellectual property

The Service, including its software, design, interfaces, compilation, databases, text, graphics, trademarks, logos, branding, and other materials supplied by TripTap, is owned by or licensed to TripTap and is protected by applicable intellectual-property and unfair-competition laws.

“TripTap” and associated names, logos, and branding may not be used without our prior written permission. No license is granted by implication, estoppel, or otherwise except for the limited license expressly stated in these Terms.

If you believe content available through the Service infringes your intellectual-property rights, send a notice to support@triptap.app containing sufficient information to identify the protected work, the allegedly infringing material, your contact information, a statement of your good-faith belief, and evidence that you are authorized to act. We may request additional verification and may remove or restrict material while reviewing a claim.

13. Feedback

If you provide ideas, suggestions, reviews, proposals, or other feedback about TripTap, you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable right to use, reproduce, modify, publish, commercialize, and otherwise exploit that feedback for any lawful purpose without compensation or obligation to you. This does not transfer ownership of unrelated User Content.

14. Updates, availability, and changes to the Service

We may issue updates, patches, new versions, or replacement features. Updates may be required to continue using the Service. You authorize the App to download and install updates where your device settings permit.

We do not guarantee that the Service or any feature, content, account, itinerary, route, AI model, third-party integration, or subscription benefit will always be available, uninterrupted, secure, error-free, or compatible with every device or operating-system version.

We may add, modify, restrict, suspend, or discontinue any feature or part of the Service, temporarily or permanently, for operational, legal, security, commercial, or technical reasons. Where required by applicable consumer law, we will provide legally required notice or remedies for a material adverse change to paid digital services.

We are not liable for outages or failures caused by third-party providers, telecommunications networks, app stores, cloud infrastructure, AI services, map providers, device settings, internet connectivity, force-majeure events, or circumstances outside our reasonable control.

15. Account deletion

You may initiate deletion of your TripTap account using the in-app account-deletion function or by contacting support@triptap.app if additional assistance is required.

Account deletion is irreversible and may result in permanent loss of saved spots, trips, itineraries, chats, images, preferences, and other account data. Before deleting, export or copy any information you wish to keep if an export option is available.

We may retain limited information after deletion where reasonably necessary or legally required for fraud prevention, security, dispute resolution, accounting, tax, enforcement, legal compliance, or backup integrity. Residual backup copies may remain for a limited period until overwritten or securely deleted in the ordinary course. Deletion does not require us to remove information that has been lawfully anonymized or that another user or third party independently controls.

Account deletion does not cancel an Apple subscription. You must cancel subscriptions separately through Apple.

16. Suspension and termination

You may stop using the Service at any time. These Terms remain applicable to prior use and to provisions that by their nature survive termination.

We may restrict, suspend, or terminate access, remove content, revoke entitlements, or take protective action if we reasonably believe that:

  • you violated these Terms or applicable law;
  • your account presents a fraud, payment, cybersecurity, safety, legal, or reputational risk;
  • your use harms or threatens users, TripTap, Apple, a service provider, or a third party;
  • continued access may expose us or another person to liability;
  • we are required to act by law, court order, regulator, app-store rule, or service provider; or
  • the Service or relevant feature is discontinued.

Where legally required and reasonably possible, we will provide notice and an opportunity to remedy the issue. We may act immediately where delay could create harm, legal exposure, security risk, or continued abuse.

Termination does not relieve you of payment obligations already incurred. Sections concerning intellectual property, User Content licenses needed for residual storage, disclaimers, liability, indemnity, disputes, and other provisions intended to survive will remain effective.

17. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” with all faults and without warranties of any kind.

TripTap disclaims all express, implied, and statutory warranties, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, availability, security, compatibility, and any warranty arising from course of dealing or usage of trade.

Without limiting the foregoing, we do not warrant that:

  • the Service will meet your needs or expectations;
  • any AI output, location, route, map, recommendation, extraction, place, price, schedule, or travel information is accurate, complete, current, safe, lawful, or suitable;
  • the Service will be uninterrupted, error-free, secure, or free from harmful components;
  • User Content will never be lost, altered, accessed, or deleted;
  • third-party services will remain available or perform as expected;
  • any destination, business, booking, transportation, or activity will be available, safe, satisfactory, or as described; or
  • defects or errors will be corrected.

Some jurisdictions do not allow certain warranty exclusions. In that case, the exclusions apply only to the maximum extent permitted, and any mandatory warranty remains unaffected.

18. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, intentional misconduct, gross negligence where non-excludable, or death or personal injury caused by negligence where applicable law prohibits exclusion.

To the maximum extent permitted by law, TripTap and its owners, directors, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss or damage, including loss of profits, revenue, opportunity, goodwill, business, data, anticipated savings, or reputation, even if advised that such loss was possible.

To the maximum extent permitted by law, we are not liable for losses arising from or relating to:

  • travel decisions, missed reservations, denied entry, visa or documentation issues, cancellations, delays, weather, accidents, illness, injury, crime, unsafe locations, restricted access, or local-law violations;
  • inaccurate or outdated AI, route, map, place, schedule, price, availability, recommendation, or imported-content information;
  • third-party content, services, platforms, providers, businesses, transport, accommodations, events, or products;
  • your User Content, unauthorized account use, failure to secure your device, or failure to keep independent backups;
  • loss, alteration, disclosure, or unavailability of data caused by circumstances outside our reasonable control;
  • service interruptions, internet failures, device incompatibility, app-store decisions, provider outages, force-majeure events, or security attacks not caused by our breach of a legally required duty; or
  • your breach of these Terms or applicable law.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid directly for the Service during the 12 months immediately preceding the event giving rise to the claim; or (b) EUR 50.

The limitations in this section apply regardless of the legal theory asserted and even if a limited remedy fails of its essential purpose. They do not reduce mandatory rights available to consumers under applicable law.

19. Indemnification

To the maximum extent permitted by law, and except to the extent a claim was caused by our own breach of law or these Terms, you agree to defend, indemnify, and hold harmless TripTap and its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, penalties, costs, and reasonable legal fees arising from:

  • your unlawful or unauthorized use of the Service;
  • your User Content;
  • your violation of these Terms or applicable law;
  • your infringement or violation of another person’s rights; or
  • a dispute between you and a third party concerning travel, content, a booking, a destination, a provider, or activity.

This section applies to consumers only to the extent permitted by mandatory consumer law. If you use the Service for business or professional purposes, this indemnity applies fully to the maximum extent permitted by law.

20. Consumer rights

You may have mandatory rights under the laws of the country where you habitually reside, including rights relating to digital content, digital services, unfair contract terms, refunds, conformity, privacy, and dispute resolution. Nothing in these Terms waives or restricts rights that cannot lawfully be waived or restricted.

Where a mandatory consumer rule conflicts with these Terms, the mandatory rule prevails only to the extent of the conflict.

21. Governing law and disputes

These Terms and any non-contractual obligations arising from them are governed by the laws of the Republic of Moldova, without regard to conflict-of-laws principles.

Before filing a legal claim, you and TripTap agree to make a good-faith effort to resolve the dispute informally. You must send a written description of the dispute and requested resolution to support@triptap.app. We will use reasonable efforts to respond within 30 days.

Subject to mandatory consumer rights and any jurisdiction that cannot legally be excluded, disputes will be submitted to the competent courts of the Republic of Moldova. Consumers retain any right under applicable mandatory law to bring proceedings before another competent court, including a court in their place of habitual residence where such right applies.

Nothing prevents either party from seeking urgent interim or injunctive relief where necessary to protect accounts, systems, confidential information, safety, or intellectual-property rights.

22. Changes to these Terms

We may update these Terms to reflect changes in the Service, law, technology, security practices, subscriptions, providers, or business operations.

For material changes, we will provide notice through the Service, by email, or by another legally sufficient method before the changes take effect where required. The updated Terms will state their effective date.

Your continued use after updated Terms take effect constitutes acceptance to the extent permitted by law. If you do not agree, you must stop using the Service and may delete your account. Changes will not retroactively reduce mandatory rights or alter completed transactions except where legally permitted.

23. Electronic communications

You agree that we may provide agreements, notices, disclosures, receipts, and other communications electronically, including through the App, our website, or email. You are responsible for keeping your email address current and for reviewing notices made available through the Service.

Service-related and transactional communications may be necessary to operate your account and are not promotional marketing. Where required, you may separately opt out of marketing communications.

24. Assignment

You may not assign or transfer these Terms, your account, or rights under the Service without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, change of control, or transfer of the Service, subject to applicable law and without reducing mandatory consumer rights.

25. Force majeure

We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including natural disasters, severe weather, war, terrorism, civil disorder, epidemics, government action, sanctions, labor disputes, power failures, internet or telecommunications failures, cloud or platform outages, cyberattacks, app-store actions, or failures of third-party providers.

26. General provisions

Entire agreement. These Terms, the Privacy Policy, purchase disclosures, and any additional terms expressly presented for a specific feature form the entire agreement concerning the Service and replace prior discussions or understandings about it.

Order of precedence. If feature-specific terms conflict with these Terms, the feature-specific terms control for that feature. Mandatory law controls over any conflicting contractual provision.

Severability. If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective.

No waiver. Failure to enforce a provision is not a waiver. A waiver is effective only if in writing and signed by an authorized representative.

Headings. Headings are for convenience and do not affect interpretation.

No partnership. These Terms do not create employment, agency, partnership, joint venture, franchise, fiduciary, or representative relationship between you and TripTap.

Language. The English version controls to the extent permitted by law. A translated version may be provided for convenience. Mandatory language requirements applicable to consumers remain unaffected.

27. Apple-specific terms

This section applies when the App is downloaded from or used through Apple’s App Store.

27.1 Acknowledgment

These Terms are concluded between you and TripTap, not with Apple Inc. or any Apple subsidiary. TripTap, not Apple, is solely responsible for the App, the Service, and their content. These Terms do not create usage rules that conflict with the Apple Media Services Terms and Conditions or applicable Apple Usage Rules.

27.2 Scope of license

Your license is limited to a non-transferable license to use the App on Apple-branded products that you own or control and as permitted by Apple’s applicable Usage Rules, except that the App may be accessed and used by other accounts associated with the purchaser through Family Sharing, volume purchasing, or Legacy Contacts where permitted by Apple.

27.3 Maintenance and support

TripTap is solely responsible for providing maintenance and support for the App as required by these Terms or applicable law. Apple has no obligation to provide maintenance or support for the App.

27.4 Warranty

TripTap is solely responsible for any product warranties that cannot lawfully be disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, paid for the App. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are TripTap’s responsibility to the extent required by applicable law.

27.5 Product claims

TripTap, not Apple, is responsible for addressing claims by you or a third party relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection, privacy, or similar laws. Nothing in these Terms limits TripTap’s liability beyond what applicable law permits.

27.6 Intellectual-property claims

If a third party claims that the App or your possession and use of it infringes that party’s intellectual-property rights, TripTap, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by applicable law.

27.7 Legal compliance

You represent and warrant that you are not located in a country or region subject to a United States Government embargo or designated by the United States Government as a “terrorist supporting” country or region, and that you are not listed on any United States Government list of prohibited or restricted parties.

27.8 Third-party terms

You must comply with applicable third-party agreements when using the App, including your wireless-data-service agreement, Apple’s terms, third-party sign-in terms, mapping-provider terms, and any terms governing content or links you submit.

27.9 Third-party beneficiary

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
